Bolsonaro admits a chance of prison and says that country lives “complete legal insecurity”

Former President Jair Bolsonaro (PL) admitted on Tuesday (2) the possibility of being arrested by order of the Supreme Federal Court (STF). In an interview with the station AuriverdeBolsonaro said he lives under constant legal threat and classified the current scenario as a “complete legal uncertainty.”

The statement was made amid the repercussion of an order by Minister Alexandre de Moraes, rapporteur of actions investigating the attempted coup d’état, sent to the Attorney General’s Office (PGR). In the document, revealed by the portal MetropolisMoraes requests that Attorney General Paulo Gonet evaluate the need for pre-trial detention of the former president to guarantee public order and preserve the procedural instruction.

According to Bolsonaro, he has warned his team about the legal risks he faces: “I even warned who works with me, driving my car, not to go close to embassies. Some criticized me back there, thinking that I was going to escape to the Hungary Embassy (…) the possibility (from being arrested) there is a complete legal insecurity.

Minister Alexandre de Moraes also requested that the PGR analyze whether Bolsonaro committed crimes of obstruction of justice, incitement against democratic institutions and coercion in the course of the process, by calling public acts requesting amnesty to the convicts of January 8, 2023.

If the accusations are confirmed, these elements may support a request for custody against the former president, who is already a defendant in the Supreme, with seven other allies, for attempted coup.

To date, Attorney General Paulo Gonet has not officially spoken out about the process. It is expected to evaluate the elements presented by the Supreme Court before any formal arrest request.

Bolsonaro’s speech reinforces the climate of tension between the former president and the judiciary, occurring at a time when his defense seeks to rule out the possibility of new precautionary measures and, eventually, from a pre-trial detention that removes it from the political scenario definitively.
