The Supreme Court Minister (STF) Alexandre de Moraes pulled to the Court an investigation investigating the secretary of government of São Paulo and president of the PSD, Gilberto Kassab. Moraes had sent the case file to the São Paulo Electoral Justice in 2019.

The minister’s decision was issued on March 19. The inquiry investigates alleged crimes of passive corruption, money laundering and box 2.

The complaints have as its origin awarded collaborations made by whistleblowers of Operation Lava Jato. They pointed out that Kassab received R $ 350 thousand monthly from J&F, brothers Joesley and Wesley Batista, and R $ 28 million to consolidate PSD’s support to PT, by President Luiz Inácio Lula da Silva, in the 2014 elections.
In 2019, Moraes sent the inquiry to the Electoral Justice of São Paulo. In the decision, he said the court was no longer competent to consider the inquiry because Kassab was no longer Minister of Science and Technology, a position he held between 2016 and 2018, during the management of former President Michel Temer (MDB)
“Due to the investigated no longer holding the position of Minister of State, the Attorney General’s Office manifested itself towards the decline of jurisdiction to the Regional Electoral Court of São Paulo, for further referral to the competent first court,” Moraes decided at the time.

However, on the 11th, the Supreme Court changed the understanding and expanded the reach of the privileged forum. The ministers recognized that authorities maintain the prerogative even after leaving the positions.
In 2018, the Supreme Court restricted the forum by function prerogative. The decision was made to lower the volume of criminal actions after the monthly. Since then, surveys and criminal proceedings involving authorities such as deputies and senators have only needed to start and end at the Supreme Court if they were related to the exercise of their mandate. Now the Court retreats and defines that when it comes to functional crimes, the forum must be maintained even after departure from office.
On the 17th, former President Jair Bolsonaro (PL) announced that he hit the PSD support with Kassab to the project that amnesty those convicted of scammers from January 8.

“I even a few days ago had an old problem and solved with Kassab in Sao Paulo. He is by our side, with his bench, to approve the amnesty in Brasilia,” Bolsonaro said at a senate conference. Estadão sought Kassab and the PSD directly and via the press office, but he did not comment.
The PSD bench in the House has 44 members. According to the Estadão amnesty score, which heard the opinion of 82% of deputies on the subject, 15 support forgiveness to scammers, while seven are opposed. Nine others did not respond and 13 did not return.
The amnesty project contains breaches that can benefit Bolsonaro and has become the former president’s main bet to get rid of judicial convictions and participate in the 2026 presidential election.

On Wednesday, 26, the first class of the Supreme Court unanimously decided to make Bolsonaro and seven other defendants for attempted coup. With the decision, the former president will be tried by the ministers and may be sentenced to up to 43 years in prison.
