Giving a major blow to the West Bengal government, the Supreme Court on Thursday termed the appointment of 25,753 teachers and other employees in government and government aided schools in the state as illegal and described the selection process as “flawed”. While giving a decision on 127 petitions regarding the decision of the Calcutta High Court, the Chief Justice said, “In our view, this is a case in which the entire selection process is flawed.” Efforts to hide the case along with large-scale manipulation and fraud have caused so much damage to the selection process that it cannot be repaired. ”
Divyang candidate job will not go- Court
The bench of Chief Justice Sanjeev Khanna and Justice Sanjay Kumar upheld the Calcutta High Court’s 22 April 2024 decision to cancel the appointments, saying, “The credibility and validity of the selection has decreased, so we have to retain it (High Court order) with some amendments. There is no need to return other allowances. However, the court gave discounts on humanitarian grounds to the disabled employees and said that they will remain in the job.
Order to start a fresh selection process
The bench fixed the date of April 4 for hearing the petition of the West Bengal government challenging the High Court’s directive to investigate the CBI investigation. Waiting for detailed decisions. On February 10, the apex court reserved its verdict on several petitions related to the case and said that those who have got the job incorrectly can be removed. The apex court also ordered the state government to start a fresh selection process and complete it within three months.
CBI will continue to investigate the case
The apex court started the final hearing on December 19 last year and heard the arguments of all the parties on 15, 27 January and 10 February before reserting their verdict on the politically sensitive matter. Citing OMR sheet tampering and other irregularities, the High Court had invalid the appointment of 25,753 teachers and non-teaching staff in the state-run and government-assisted schools in West Bengal. On May 7 last year, the apex court stayed the High Court’s order regarding the appointments made by the State School Services Commission (SSC). However, the apex court allowed the CBI to continue the investigation of the case.
What is the matter?
The case is related to alleged irregularities in the 2016 recruitment process conducted by West Bengal SSC, in which 23 lakh candidates were involved for 24,640 posts and a total of 25,753 appointment letters were issued. The apex court called it a “systematic fraud”. Former West Bengal Education Minister Partha Chatterjee and Trinamool Congress MLA Manik Bhattacharya and Jeevan Krishna Saha are among the accused under investigation in the recruitment scam.
