The Supreme Court of the US on Wednesday gave an important verdict, allowing US President Donald Trump to remove three Democrat members from the Consumer Produce Safety Commission (CPSC). The case came to light when the Trump administration removed these members and later reinstated them by a federal court. This decision of the Supreme Court has empowered the President to remove the ‘without’ commission.
CPSC is an independent agency that serves to protect consumers from unsafe products. It consists of a total of five members, out of which more than three cannot be from the same party. Trump removed three Democrat members of the Commission in May, appointed by the President Joe Bidon. In June, the District Judge Matthew Madox of Baltimore called Trump’s action illegal, which has now been overturned by the Supreme Court.
President’s right to remove ‘without reason’
In this case, the US Department of Justice appealed to the Supreme Court that the President had every right to remove agency members as the executive chief. The Conservative Judges of the court admitted the plea that the President is free to remove any commission member without any concrete reason. However, three Liberal judges of the court disagreed with this.

Questions raised on the decision of 1935
The decision has brought the historic decision of the 1935 Supreme Court ‘Hansi Executive Case’ to the center of debate again. At that time the court said that the members of the independent agency cannot be removed ‘without reason’. But now this tradition is considered to be a hindrance for Conservative ideology, which believes that such agencies should be under the President.
The freedom of the commission is threatened?
The CPSC was built in 1972 and the aim of its structure has been to get control of it, but it should not be completely occupied. Lawyers of dismissed Democrat members had said in the court that such dismissal could weaken the commission’s freedom. They believe that this step of Trump is against the balance of the Constitution.
