The Bombay High Court on Friday dismissed the CPI -M petition. The petition challenged the Mumbai Police not to allow demonstrations against the alleged massacre in Gaza. The court advised the party to focus on the internal issues of the country instead of abroad. At the same time, the CPI (M) criticized the court’s remarks and said that it has ignored the rights given in the Constitution and the policy of traditional support of Palestine.
The case began when the Mumbai Police did not allow the ‘Akhil Bharti Shanti and Saqata Sangathan’ last month to rally in protest against the alleged massacre at Gaza at Azad Maidan in South Mumbai. After this, the Communist Party of India (Marxist) filed a petition in the court. A bench of Justice Ravindra Ghoga and Gautam Ankhad dismissed the petition that the party should focus on the problems inside the country and not thousands of kilometers away incidents.

On behalf of the CPI (M), advocate Mihir Desai argued in the court that the police did not allow on the basis that this could worsen the law and order. He said that citizens have the right to perform peaceful demonstrations at fixed places and this right cannot be ruled out only on the basis of apprehension of law and order. However, the court did not accept the plea and dismissed the petition. The CPI (M) then issued a statement criticizing the court’s comment.
The CPI -M Polit Bureau said, “We strongly condemn the comments made by the High Court while dismissing the CPI -M petition.” The party was not allowed to protest against the Israeli massacre in Gaza. The party said that the court questioned his patriotism and said that the party should not raise issues that affect foreign policy. The CPI (M) also said that the court suggested that the party should work on local issues like garbage management, pollution, sewer and floods and not on foreign events. According to the CPI (M), the court is ignoring the rights given to political parties in the constitution and the tradition of India’s historically the support of Palestine. The party also said that the court’s comment is seen in accordance with the policies of the central government.

The CPI (M) said that Mahatma Gandhi, the freedom struggle and the foreign policy of independent India have always been supporting the right to self -determination of Palestinians. The party said that the court has condemned Israeli action around the world and has also ignored the comments of the United Nations and International Court of Court.
