The federal deputy Duda Salabert (PDT-MG) presented on Monday (31) a bill that prohibits the granting of amnesty to investigated or convicted of crimes against democratic institutions, as an attempt to coup or violent abolition of the Democratic Rule of Law.

The proposal was filed on the day of 61 years of the 1964 military coup, and a few days after the Federal Supreme Court (STF) made former President Jair Bolsonaro (PL) defendants and seven allies by the alleged coup plot of 2022.

“The preservation of democratic institutions and the guarantee of fundamental rights require measures that prevent the impunity of acts that undermine the constitutional order and the legitimate functioning of the state powers,” Salabert wrote in the justification of the project.

Pressure on the PL of Amnesty

Although it does not innovate in legal terms – since the Constitution prohibits amnesty to crimes such as torture, trafficking and terrorism – the initiative has symbolic and political value, reinforcing the siege of the amnesty proposal articulated by Bolsonarist parliamentarians in Congress.

The so-called Amnesty PL aims to benefit those involved in the scammers of January 8, 2023, and has the support of the opposition, which now pressures the mayor, Hugo Motta (Republicans-PB), to guide the project urgently, ie directly in the plenary.

The ruling base tries to curb the advance of the proposal and prevent it from being voted at the touch of cash.
