After the Oktoberfest, Jens Lehmann was caught with alcohol at the wheel. The public prosecutor initially saw a criminal offense, only an administrative offense. Now there is a judgment.

The Munich District Court sentenced the former national goalkeeper Jens Lehmann to a fine of 1,000 euros for an alcohol trip to the Oktoberfest. The court rated that Lehmann was caught with over 0.7 per thousand alcohol in the blood with over 0.7 per thousand. Because Lehmann has already served the driving ban imposed by one month, he also gets his driver’s license back after the court’s decision.

Significations such as a lack of cooperation, a washy language or an unsafe passage that the police officers had observed in Lehmann in September last year were no undoubtedly due to his alcohol consumption, the judge decided – nor did his behavior towards the police and the doctor in blood withdraw.

Lehmann also had a conspicuous behavior in court, a certain “bad behavior”. Therefore, it can be assumed that “they would have behaved similarly in the sober state,” said the judge towards Lehmann.

The public prosecutor had originally accused a criminal offense and set a fine in a penal order, but had already deviated from the demand in the final plea. According to Lehmann’s defender, the fine was 72,000 euros. Because Lehmann had filed an objection to this penalty order, the trial occurred before the district court.

At the beginning of the trial, Lehmann had admitted that he got into the car and dangers after he had previously drunk two beer and a beer-water mixture at the Oktoberfest. He regretted that, said Lehmann. He regretted “that I misjudged and thought I could drive a car,” he said in his last word.
