The Federal Court of Justice (BGH) wants to deal with the demands of shareholders in the Wirecard insolvency proceedings in October. The question is whether damaged shareholders with their claims for damages as simple creditors are to be involved in the distribution of the bankruptcy estate or not. The Supreme German Civil Court scheduled a negotiation in Karlsruhe on October 16. (Az. IX ZR 127/24)
The Munich Higher Regional Court last issued a so -called interim judgment in September 2024. It decided that the shareholders can claim their claims for damages as insolvency claims. So far there has been no highest judge. The BGH should now clarify whether the demands of shareholders have the same rank as the demands of creditors to whom a bankruptcy company owes money.
All in all, it is about a lot of money: According to the court, around 50,000 Wirecard shareholders have registered claims for damages of around 8.5 billion euros for the bankruptcy table. In total, the Wirecard believers demand 15.4 billion euros. The bankruptcy estate is currently around 650 million euros. In any case, the creditors will only get a small part of their demands.
