The National Road Safety Agency (ANSV) published on Wednesday in the Official Gazette a new regulation that redefines the Traffic infractions considered as serious offenses, together with the procedures for the suspension and subsequent rehabilitation of the Driver license.
The measure was formalized through provision 91/2025, in complement with Decree 196/2025, released on March 17, which introduced significant reforms to the National Traffic Law No. 24,449.
When can they suspend the driver’s license
Among the main changes, the regime applicable to drivers that circulate with their first driver’s license was modified. From now on, they should no longer renew it per year, but will remain under an observation period of 24 months. During that time, if they commit serious infractions, they can lose registration and must render the theoretical, practical and/or psychophysical exams again, as provided by the corresponding authority.
However, regulation published this week not only applies to beginner drivers. It also establishes what behaviors are considered serious offenses and can derive in the suspension of the registration for any holder of a current license.
According to the provision, the ANSV may intervene in two situations: when they are detected serious infractionsregardless of whether the driver is novel or not; and when an inadequate psychophysical condition is evidenced that represents a risk for third parties, compared to the requirements required at the time of granting the license.
In these cases, the agency will send a notification to the jurisdiction issued by the license, attaching the background and requesting the corresponding suspension.
In addition, when a violation of traffic regulations is verified, the corresponding contravention complaint will also begin. This means that, in addition to the possible license suspension, the driver must face the payment of a fine proportional to the fault committed.
Which are considered “serious infractions”
“Serious infractions” will be considered, according to the official text:
a) Driving in a state of alcoholic intoxication
b) Excess of the maximum speed limits allowed
c) Driving vehicles without respecting the signaling of traffic lights
d) Driving vehicles using cell phones
e) Driving vehicles without wearing the seat belt, or regulatory helmet in case of motorcycles.
Faced with this type of infractions, Jurisdictions issued by driving licenses can act ex officio. However, the National Road Safety Agency (ANSV) is also empowered to request the suspension of the license of the drivers involved.
Step by step, this will be the suspension procedure
In cases where the ANSV becomes aware of any of the causes indicated:
- He will send a note to the jurisdiction granting with the background and “will request the suspension of the same.”
- The granting jurisdiction must, “within five days, take the reason for the suspension or found its refusal, communicating its decision to the National Road Safety Agency.”
- In case of suspension, the local authority and/or the ANSV will notify the individual affected and “will cite it so that, within five days, the corresponding examination as appropriate, under the warning of decreeing their disqualification.”
DRIVING LICENSE: This is renewed by the card after changes in the Traffic Law
The Government issued Decree 196/2025 that modifies the Traffic and Road Safety Law to modernize the driver’s licensing system and make it much more agile to obtain the Card renewal, for both individuals and professionals.
The truth is that now the National driver’s license is valid in its digital version throughout the country, available in the my Argentina application. In this way, physics becomes optional to the driver.
As for renewal, the process was simplified. Private vehicle drivers (types a, b and g) will only need one Psychophysical skills check made by a doctor accredited by the National Road Safety Agency (ANSV).
This change eliminates the need to present itself in a municipal centerallowing the procedure to be completed digitally.
