The woman’s lawyer who denounced Dani Alves for rape, has announced that he will resort to the absolution of the footballer. Ester García has explained that the complainant feels “very disappointed and very sad” and “she felt she returned to the bathroom where the events occurred.”

Speaking to the media at the gates of his office, Garcia has lamented that the acquittal of Alves represents “a setback in the fight against the violence of women, both at the legal and social level”, which can discourage to denounce the victims of sexual aggressions.

After recognizing that it is a sentence they did not expect, Garcia has told that the complainant is “very disappointed and very sad.” “He has somehow felt as if he returned to the bathroom where the events occurred,” he added.

The lawyer has announced her intention to resort to the Supreme Absolution of Alves, although she has specified that her priority is the “emotional recovery” of the young woman, so they must assess that “it can be sustained” during the time late in resolving the appeal, which could take a year.

“Using not to put an end to the procedure,” said Ester García, after remembering that the judicial journey and media exposure “wears out a lot emotionally to any victim of sexual violence.”

Garcia has lashed out at the sentence, which bases the acquittal on which the images of the moments before Alves and the complainant will enter the bathroom do not agree with the story of the latter, and recalled that “the facts subject to procedure are not that he was dancing.”

“Questioning a woman because she has been dancing in a nightclub I think it is a debate that in the 21st century does not have to have it,” he lamented.

For the lawyer, by the images of the cameras “it cannot be interpreted if (the complainant) was afraid before entering the bathroom”, since it is a distant and dark recording.

Ester García has addressed the women journalists who listened to them to ask them: «How many times have you not felt insecurity and it has not been transmitted directly? Affirm it by a photographic report or recordings of a dark zone leads to a debate that should not exist today ».

“That has nothing to do with the credibility of my client,” added Garcia, recalls that the TSJC judgment admits that the complaint of the complainant has always been “persistent” and that the four times he has reported the facts has remained in the same version.

The defense considers that the concept of reliability on which the sentence is based is “moving away from the most recent jurisprudential doctrine, which emphasizes that the moments prior to sexual assault should not be part of the legal debate.

On the possibility that Dani Alves abandon Spain by having lifted the precautionary measures -irrigated by the passport and periodic appearances before justice -, Garcia has commented that this is “the youngest” of his concerns.
