The Delhi High Court on Wednesday dismissed a petition seeking singer and rapper Yo Yo Honey Singh to instruct him to amend the lyrics of his new song ‘Maniyak’. It said that obscenity has no religion as the petitioner alleged that women were sexually abused using Bhojpuri lyrics in the song. Chief Justice D.K. A division bench of the High Court of Upadhyay and Justice Tushar Rao Gedela made this comment while hearing a petition filed by Luv Kush Kumar. His lawyer claimed that pornography has been made normal by using Bhojpuri language in this song and women have been sexually abused.
Court reprimanded
The bench told Kumar’s lawyer, ‘There is no religion of vulgarity. It should be unconditionally. Never say Bhojpuri pornography. What is this? Porn is obscene. Porn is obscene. In his petition, Kumar said that in the song, the song has clearly promoted sexualization by portraying women as an object of sexual desire, double meaning has been used. He further said that the song has attracted a lot of attention due to its pornographic words and its lyrics are filled with vulgar language, introducing women as objects and inappropriate contexts that are contributing to the culture of disrespect and genderism.
Court dismissed petition
The court commented that Kumar’s petition was not conscious as he was seeking relief against a private person. The bench said, ‘We cannot release any writ. Rit is issued against states, state institutions. Your case is not under the purview of public law but in the purview of private law. The writ petition will not be a lie. However, the court suggested Kumar to follow other measures under the law, including registering a criminal case. The court said, ‘If it is a crime and it should be considered, then why can’t you register an FIR? If this is a criminal case, please file an FIR, if it is not recorded then you know the process.
PIL filed against obscenity
The petitioner had demanded the court to issue appropriate instructions so that the words of this song could be revised and the content of such songs could be regulated. The petitioner also demanded the officials related to the High Court to amend the vulgar and derogatory lys of the song ‘Maniq’. However, the Delhi High Court will no longer hear the matter. The petitioner has made the song singer Yoyo Honey Singh, Leo Grewal, Ragini Vishwakarma as well as T Series, Google and YouTube as defendants.
