Pierre Palmade can serve the end of his prison sentence under electronic bracelet. Five months after his conviction to five years in prison – three of which were suspended – for causing a dramatic traffic accident while he was driving Drogué, the Bordeaux court of appeal accessed this Tuesday at his request for sentence. This request had already been granted to him in February, but the prosecution opposed it, judging the schedules too large. This time, they were restricted, specifies the public prosecutor’s office.
The fallen humorist had been detained since December 9 in Gradignan prison. How to explain that four months later, Pierre Palmade can find a form of freedom? And this, while the Melun Criminal Court sentenced him to two years firm and he did not appeal. “The electronic bracelet is a modality of execution of a firm sentence,” replies immediately Ivan Guitz, honorary magistrate and former president of the National Association of Judges for Application of Sentences. Clearly: this is a form of home detention.
A request for placement under electronic bracelet as soon as it is put under nut
The lawyers of Pierre Palmade had formulated on the day of his incarceration a request for liberation under electronic bracelet. “Since 2020, when we have been sentenced to sentence greater than a firm year, you cannot escape the prison box. But when the penalty does not exceed two years, we can apply for placement under bracelet as soon as it is put under nut, ”specifies the magistrate. The judge to apply sentences then has four months to study the request.
The prisoners’ guarantees, his outing project and the risk of recurrence has notably screened. In the case of the Palmade affair, the lawyers of the former humorist highlighted his health problems and the need for increased medical follow -up to treat his addictions.
Confessions during his trial
During the trial, in November, he told “his slow descent into hell”, locked in his addictions to drugs and sex. He recognized that that day, he had injected himself eight times from 3-MMC, a very addictive synthetic drug then had taken “three, four” lines of cocaine before taking the car. Driving behind the wheel, he struck a car head on, very seriously injuring a father and his little boy as well as a woman who lost the child she wore.
On February 26, the penalties’ tribunal access to the Liberation request under the electronic bracelet of Pierre Palmade, but the prosecution immediately called on “with regard to the hourly terms of the planning granted”. Clearly: he did not oppose the principle of placement under bracelet but estimated that the schedules granted, 9 am-7 am, were too large. The prosecution claimed that the former actor could go out in the morning.
Reduction of sentence and parole
It remains a question now: how long will Pierre Palmade carry his bracelet? Like any detainee, he can benefit from a reduction in sentence. Provided obviously to have respected the imposed hours, continued its treatment, makes efforts in terms of integration … “The judge of application of the sentences has a very large room for maneuver, he can grant a few weeks or months, it is really depending on each file”, specifies Ivan Guitz. However, this sentence cannot exceed half of his firm sentence, one year for Pierre Palmade. In half his prison sentence, he will also be able to request parole.
In one case as in the other, this means that it will no longer be required to wear the electronic bracelet and therefore at fixed timetables but will have to comply with a certain number of obligations, including care. If he does not respect them, a judge may decide to send him back into detention.
