Supreme Court expressed displeasure over the order of the High Court
The Supreme Court on Tuesday expressed displeasure over the Allahabad High Court order stating that the rape victim herself has invited trouble. The bench headed by Justice BR Gavai found the comment extremely insensitive. In a controversial order, the Allahabad High Court while granted bail to an accused of rape, saying that the complainant agreed to go to the house of the applicant and “invited trouble himself”, this news came a few days after the Supreme Court to intervene by the Supreme Court to stop the “insensitive” order passed by another High Court Judge in a case of rape attempt.
The order passed last month by Justice Sanjay Kumar Singh said that the woman is a student of MA and hence she was “able to understand the morality and importance of her act. The court said that, yes, bail can be granted .. But what is the discussion that she herself has invited the trouble, etc. Justice Gawai listed the case after four weeks.
Last week, the petition challenging the High Court order by the Civil Society Network Network Justice for Children Alliance and the victim’s mother came to hear before the bench of Justice BR Gavai and Augustine George Christ.
