Hearing in Supreme Court on petitions against Waqf law, petitions of these leaders are in the list

New Delhi: The Supreme Court will hear several petitions challenging the constitutional validity of the Waqf Amendment Act 2025 on Wednesday. These include petitions by AIMIM supremo Asaduddin Owaisi, Aam Aadmi Party leader Amanatullah Khan, Rashtriya Janata Dal MP Manoj Jha and Trinamool Congress MP Mahua Moitra and others. Chief Justice Sanjeev Khanna, Justice Sanjay Kumar and Justice K.V. Vishwanathan’s 3 -member bench has so far listed 10 petitions in the case for hearing.

List of petitioners

The petitions filed in the apex court include the following prominent petitioners:

  14. Communist Party of India (CPI)
  15. Vijay (Tamilga Vatri Kazhagam chief)
  16. All India Muslim Personal Law Board (AIMPLB)

The first 10 petitions given in this list have been listed for hearing and the remaining petitions are yet to be listed. Apart from this, advocates Hari Shankar Jain and Mani Munjal have also filed a separate petition, which has challenged their constitutional validity, describing some provisions of Waqf law as a violation of fundamental rights of non-Muslims. Several other petitions have also been filed, which are yet to be listed.

Central government’s response

On April 8, the Central Government filed a cavity in the Supreme Court, requesting that its side be heard before passing any order in this case. The purpose of the cavity is to ensure that no order is issued in the absence of the petitioner. The Center recently notified the Waqf (Amendment) Act, 2025, after which the dispute has arisen.

Major arguments of petitions

The petition of Asaduddin Owaisi argues that reducing the protection given to Waqf is discriminatory towards Muslims and it violates Article 14 (Right to Equality) of the Constitution (Right to Equality) and Article 15 (stopping discrimination on the basis of religion). Other petitioners have also questioned the validity of the Act against various articles of the Constitution, stating that the provisions of the Act. The petition of advocate Hari Shankar Jain and Mani Munjal claimed that some provisions of Waqf Act violate the fundamental rights of non-Muslims.

What will happen next in court?

On 7 April, a bench headed by Chief Justice assured senior advocate Kapil Sibal to consider listing the petitions on behalf of Jamiat Ulema-e-Hind. In addition, AIMPLB filed its petition on 6 April. The case will be heard in the Supreme Court on Wednesday in which all the listed petitions will be considered simultaneously. Many other petitions that are not yet listed can also be included for future hearing. (With PTI inputs)
