Former judge of Punjab-Haryana High Court acquitted from CBI court after 17 years, got Rs 15 lakh at home gate

Chandigarh: A special CBI court on Saturday acquitted former Punjab and Haryana High Court Judge Justice (retired) Nirmal Yadav and four others in connection with the case of cash at the door of the judge’s house. In this case, on 13 August 2008, a packet of Rs 15 lakh was allegedly sent to the residence of another working High Court judge Justice Nirmaljit Kaur. It was alleged that this cash was to be given to Justice Nirmal Yadav as a bribe to influence a property deal.

Nirmal Yadav reacted to court decision

After acquitting, Nirmal Yadav said that I was exempted from appearing by the court, but still I used to keep information about the hearing. This is a very long process … I had high expectations from life before retirement. My ambition was to go to the Supreme Court. I wanted to do a lot, but because of this I could not. I have no regrets, I have used this time to do positive work.

Five people were made accused in the case

The court of Special CBI Judge Alka Malik gave the verdict on Saturday. Defense lawyer Vishal Garg Narwana said that the court acquitted former judge Nirmal Yadav and four others. There were a total of five accused in the case, one of whom died during hearing. The lawyer said that false allegations were made against the judge. The court on Thursday heard the final arguments in the case filed by the CBI against Nirmal Yadav and fixed March 29 to pronounce the verdict.

In this case, the names of former Additional Advocate General of Haryana Sanjeev Bansal, Delhi hotel businessman Ravinder Singh, businessman Rajiv Gupta and another person were also revealed. Sanjeev Bansal, one of the accused, died of illness in February 2017. The matter was reported to the Chandigarh Police, after which an FIR was registered in the case. However, the case was later handed over to the CBI.

Transfer was done in Uttarakhand High Court

Justice Yadav was shifted to the Uttarakhand High Court after the name of Justice Yadav came to the Judge’s house. In December 2009, the CBI filed a ‘closure report’ in the case, which was rejected by the CBI court in March 2010 and ordered an inquiry again.

In 2011, President approved prosecution

The then Chief Justice of the Punjab and Haryana High Court approved it in November 2010 after the CBI demanded permission to prosecute Justice Nirmal Yadav. The President approved the prosecution in March 2011. The CBI filed a charge sheet against Justice Nirmal Yadav on March 4, 2011, who was then a judge in the Uttarakhand High Court. He was transferred from the Punjab and Haryana High Court in November 2009.

69 witnesses were questioned

The special CBI court on 18 January 2014 framed charges against Justice Yadav in the case when the Supreme Court dismissed their petition to stay the lower court proceedings. The CBI had said that Justice Yadav committed a punishable offense under the Prevention of Corruption Act, 1988. During the trial, the prosecution questioned 69 out of 84 witnesses. In the 17 -year hearing period, several judges heard the case.
